Welcome to Buky Smart Stories. Before using the application, please read these Terms and Conditions carefully. By downloading or using the app, you accept these terms in their entirety.

1. General information

Buky Smart Stories is an application developed and operated by Nicolas Bukstein, an independent developer based in Uruguay. For any inquiries, you can contact us at feedback@bukysmartstories.com.

2. Description of the service

Buky Smart Stories is an iOS application designed for parents who wish to support their children's emotional development through personalized stories generated with artificial intelligence.

Main features include:

• Buky Series: predefined stories focused on specific childhood emotional situations.
• Free story creation: generation of personalized stories through AI based on preferences entered by the parent.
• Children's profiles: users can create profiles with nickname, age, gender, and personality traits, stored exclusively on the device.
• Saving and sharing stories: stories can be saved locally and shared through the operating system's native sharing flow.
• Subscriptions: access to premium features through monthly or annual subscription plans.

3. Minimum age and parental responsibility

Buky Smart Stories is designed to be used by adults (parents or legal guardians). It is not intended for direct use by minors. Parents are solely responsible for any use their children may make of devices where the app is installed.

Using Buky Smart Stories implies acceptance of these Terms and Conditions. If you do not agree with any of them, please do not use the application.

4. Subscriptions and payments

4.1 Available plans

The app offers a monthly plan at USD 4.99 and an annual plan at USD 39.99, with access to premium content and features. Current prices are displayed in the App Store before confirming the purchase and may vary by currency or region.

All users can create up to 10 free stories per month. Users with an active subscription can create up to 120 stories per month.

4.2 Payment processing

All payments are processed by the official Apple App Store. Buky Smart Stories does not store or have access to your credit card data or other payment methods.

4.3 Automatic renewal

Subscriptions automatically renew at the end of each period, unless cancelled at least 24 hours before the current period expires. You can manage and cancel your subscription from the Apple ID settings on your device.

4.4 Refund policy

Refunds are governed by the policies of the Apple App Store. If you have any issues with your purchase, contact us at feedback@bukysmartstories.com and we will do our best to help.

4.5 Trial period

If a free trial period is offered, it begins at the time of subscription and cannot be combined with other offers. If you do not cancel before the trial period ends, you will be charged the price corresponding to the selected plan.

5. Intellectual property

5.1 App content

All original elements of Buky Smart Stories — including the Buky character, visual design, interface text, source code, and graphic elements — are the property of Nicolas Bukstein and are protected by applicable intellectual property laws.

5.2 AI-generated content

Stories generated through the app are produced by third-party artificial intelligence models. Nicolas Bukstein does not guarantee the originality of, nor claim exclusive rights over, the generated content. Users may use the generated stories for personal, non-commercial use.

5.3 User content

By entering information (child's name, personality traits, story preferences), the user declares that such content is appropriate and that they have the right to provide it. Buky Smart Stories does not claim ownership of that information.

6. Acceptable use

The user agrees not to:

• Use the app for illegal purposes or in violation of third-party rights.
• Attempt to access, modify, or interfere with the app's systems or infrastructure.
• Reproduce, distribute, or commercialize the app's content without express authorization.
• Use the app to generate harmful, offensive, discriminatory, or inappropriate content for minors.

7. Disclaimer

Buky Smart Stories is provided "as is," without warranties of any kind, whether express or implied. We do not guarantee that:

• The app will function without interruption or errors.
• Generated stories will always be appropriate for all ages or situations.
• The results of using the app will be specific or guaranteed for the emotional development of any particular child.

The app is a complementary tool for entertainment and parental support, and does not replace guidance from mental health or education professionals.

8. Limitation of liability

To the extent permitted by applicable law, Nicolas Bukstein shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the app, even if advised of the possibility of such damages.

The total liability of Nicolas Bukstein to the user, for any reason, shall not exceed the amount paid by the user in the last 12 months for the use of the app.

9. Modifications

We reserve the right to update these Terms and Conditions at any time. In the event of substantial changes, we will notify users through the application itself or via a notice in the App Store. Continued use of the app after notification implies acceptance of the new terms.

10. Applicable law

These terms are governed by the laws of the Oriental Republic of Uruguay. Any dispute arising in connection with these terms shall be submitted to the jurisdiction of the competent courts of Uruguay.
